Illegal domain

Post by skemmite »

Its the same with the Alex wall. The original charter states specifically that all Bootle residents have free access to the river but they just overide the law and no-one can stop them because of inadequate legal funding to stop them. At least its not ambigous. It states ALL BOOTLE Residents have rights to access the river. It-s there in black and white yet they have weird rules that stop us. These so called rules are illegal. Of course you can come up with the dough to oppose it. Utter Corruption.

Born and grew up in Bootle. Within walking distance of Alex. Charter gives right to all born there as well as residents. It goes back to when City took over the shoreline to build the docks.

About 6 years ago some anglers who had their tackle confiscated got a magistrate to order its return after showing a copy of the original charter. Was a minor victory. To enforce its terms on the dock operators would require civil action and a fund was set up to try achieve it. Would have to research back to find exact details. Its on internet somewhere.

Good luck in your fight for the rights of people who where born or are living in Bootle to fish.

I know it might come as a surprise, but some people from anywhere in the UK can fish the docks at Liverpool if they join POLSAF -- OK it's not unrestricted access for Bootle residents, but as a non-Bootle resident, I would prefer:

Restricted fishing for anyone who can be bothered to join POLSAF or one of the affiliated clubs.

to:

Unrestricted access to the river for anyone from Bootle, past or present.

As a Skelmersdale-residing-Bootolean , I can see the benefit for you of unrestricted Bootle access.

( Surely it only needs the Charter to get amended or repealed or revoked or superseded by another Charter or act of Parliament to make even Bootle residents claims, null and void -- the problem being [ for Peel or whoever ] that the Charter wasn't changed before the last court case ).

I personally, again as a non-Bootolean --- or whatever -- think that it is amazing that one of the busiest ports in the UK, allows anglers to access the docks at all and gives them anywhere to fish and doesn't charge them more than an ISPS pass costs to any other user of the port.

There must be a grey area, otherwise, they would be compelled to let anyone from Bootle to walk in ( and NOBODY else ) or they would stop everyone -- as it is they seem to be compromising -- and it seems to be Anglers who are being confrontational in the face of some unbelievable compromise from a massive company.

Is just my humble opinion ( and I do have some knowledge of the workings of POLSAF, Peel and MDHCo -- and the court case, and the charter )

We went through all of this a few years ago...the Gladstone Wall is classed as Bootle promenade which should be accessible to all,but like everything else, times change and since the Magna Carta,Peel Ports have arrived. The docks are a completely different place compared to years ago, with big business being over-shadowed by health n safety, which gives them the perfect excuse to make life very difficult for anglers.

The problem is Health and safety laws. They have gone mad as witnessed by anyone in the construction industry. Basically the whole north docks is now a massive construction site and with this comes all the HSE legislation which Peel will use to limit our access. Ancient laws don't cut it. If I lived in Chester and caught a welsh man after dark i could shoot him and , in theory it would be legal as the original law still stands , but laws passed since then means I would get life!
Same with Bromborough the access to the wall is now a construction site.
Until all anglers are together united under 1 body and wiling to part with plenty of hard cash we will face losing our venues. Taking firms to court costs big time and sea anglers are mostly , "carefull" with their dough!
The only upside to this is that , anglers will try fishing different venues .

When Seaforth Rocks was available why would you want to fish anywhere else apart from a change of scenery. The trouble with "different" venues is that they are, for the most part, s***e

Yes seaforth Rocks is an excellent venue , but you can't fish it any more so if different venues are sh@te, are you going to give up fishing? Or will you try the different venues and try to Suss out how to catch fish at different venues? In my experience most venues can throw up fish in the right conditions to the right bait and tactics. I have fished up and down the country and used loads of different methods, but find most anglers stick to the same thing all the time and that is why they fail on some venues a good example of this is when I fished a two day match at Chesil beach a few years back, first day was a disaster, halfway through the 2nd with only a pout and whiting on the card I switched to a washing line float rig with a rig extension and battered the garfish. If I wouldn't have changed my thinking and tactics that venue would have been Sh@te in my mind, while in reality it would have been me that was Sh@te! For not changing.

Whatever any one says its a simple fact no-one including Big Companies has the right to alter legal agreements arbitrarilary without Official legislation. Which they did not do and thats why the Anglers were given their tackle back. QED. The big Company did not go to court or anywhere else to alter the terms of the Charter . Its Illegal Domain.

Your right. But they can deny you access on health and safety grounds if it's a construction site. Unless you have been inducted , hard hat , safety boots hi viz clothing ,and all the other Bollox that goes with it. If us anglers mounted a serious legal battle to get back unlimited access to liverpool docks they would go to court and with their finances they would be hard to beat . I don't think these big companies give a stuff about the law. Break it , get a small fine , then carry on as before!
